The right to use a land fund is called "concession". It is legally established by a registration certificate of land granted by the State. It is unassailable after two years from the date of its establishment.
So regularly registered land rights are secure.
- There are two types of concessions :
- Perpetual concession, reserved for Congolese (without time limitation)
- Ordinary concessions available to Congolese and foreigners (for a period of 25 years renewable without any limitation).
- Identification of land by the person concerned
- Signature of an agreement with customary authority of the place, against payment of a sum of money and material goods according to custom
- Earth vacancy survey and demarcation by the relevant departments of the State (local services of the Ministry of Agriculture and the Ministry of Land Affairs)
- Signature of the concession contract (Registrar of Titles spring real estate)
- Obligation to development of land within a period of 3 years renewable twice for a period of 2 years (ie the development must take place within a maximum period of 7 years, if the State takes the field)
- Establishment of the certificate of registration by the Registrar of Titles of the spring.
- The contract must be approved by a law for blocks of land equal to or exceeding 2000 ha (Contact the Department of Land Affairs)
- The contract must be approved by order of the President of the Republic for the blocks of land above 1000 ha and below 2000 ha (contact the Ministry of Land Affairs) ;
- The contract must be approved by the Ministry of Land Affairs for blocks of land over 200 ha, not exceeding 1000 hectares
- The contract must be signed by the Governor of the Province for blocks of land equal to or below 200 ha. The Provincial Governor may delegate his powers to the Registrar of Real Estate Titles for land under 50 ha.
- Submission of the concession application with the Registrar of Real Estate Titles of the area
- Signature of the lease contract (preparatory to the concession)
- Technical work (markers, measurements ...) by geometers of the Administration concerned
- Obligation to develop land within a 3-year period renewable twice for a period of 2 years (i.e. the development must 8 take place within a maximum period of 7 years, otherwise the Government takes back the land)
- Enhancement finding by the Cadastre department
- Establishment of a registration certificate (final title).
- The contract must be approved by a law for blocks of land equal to or exceeding 100 ha (Contact the Ministry of Land Affairs)
- The contract must be approved by Order of the President of the Republic for blocks of land above 50 hectares and less than 100 ha. (Contact the Ministry of Land Affairs)
- The contract must be approved by Decree of the Minister of Land Affairs for blocks of land over 10 hectares, but not exceeding 50 ha
- Agreement between the parties
- Signing of the sales contract and authentication of the contract in front of a notary
- Returning the old certificate of registration to the Registrar of real estate securities for its cancellation
- The payment of administrative fees (ad valorem) set at 3% of the value of the property in the Treasury account
- Establishment of the new registration certificate on behalf of the new owner.
