HOLDINGS: [1]-Consistent with Lab. Code, § 2699, subds. (a), (c), providing that penalties in a Private Attorneys General Act of 2004, Lab. Code, § 2698 et seq., action were recoverable by an employee affected by at least one of the alleged violations, an employee who brought a representative action and who was affected by at least one of the violations alleged in the complaint had standing to pursue penalties on behalf of the state not only for that violation, but also for violations affecting other employees, and could recover penalties for all of the alleged violations if proven; [2]-A claim of failure to promptly pay wages on termination was not raised for the first time after trial, but was properly alleged in the complaint; [3]-The trial court did not abuse its discretion by dividing the trial into separate phases; [4]-The employer had adequate notice of the prompt payment issue.

Outcome Order affirmed.
