Terms and Conditions - saayam-for-all/docs GitHub Wiki

Welcome to Saayam For All (“Saayam”, “we”, “us”, or “our”). By accessing or using our websites (including saayam.org, saayamforall.org, and saayamforall.com), mobile applications, or services (collectively, the “Platform”), you agree to be bound by the following Terms and Conditions. These Terms are designed to inform you of your rights and responsibilities as a user, volunteer, or organization interacting with our community-driven, humanitarian platform.

Overview

Saayam For All is an volunteer-based organization that helps connect people in need with compassionate local volunteers. We operate through a cloud-native application that supports requests for essentials such as food, housing, education, healthcare, clothing, and general guidance. This platform is driven by values of service, inclusion, and humanity, and is free of religious, political, or commercial bias. By using Saayam For All, you accept and agree to abide by these Terms in full.

1. Our Mission

Saayam For All is a humanitarian platform rooted in compassion, built entirely by volunteers and experts who believe in service to others. Our mission is to bridge the gap between people in need and those who are willing to help. The platform is inspired by the principles of selfless service, inclusivity, and technological empowerment. We aim to be a global hub where anyone can request essential assistance, and volunteers can offer their support without the expectation of compensation. Our model is not just charitable; it's transformative, as it fosters global solidarity through local action.

2. Eligibility

To use Saayam For All, individuals must be at least 18 years of age or must use the Platform under the supervision and consent of a legal guardian. This ensures that all users can engage responsibly within our system. Eligibility criteria may also apply to volunteers and organizations depending on their location, field of service, and capacity to help. By registering, you affirm that the information you provide is accurate and that you are legally permitted to use our services under your local jurisdiction.

3. User Roles

The Platform is composed of different user roles: Beneficiaries, Volunteers, Organizations, and Admins. Each role has specific permissions and responsibilities. Beneficiaries are those who seek help in categories like food, shelter, education, and healthcare. Volunteers provide assistance based on their expertise and availability. Organizations can register to amplify their charitable reach by working through Saayam For All. Admins are approved personnel who maintain the platform’s safety and efficiency. Role-switching and multiple-role accounts may be allowed, provided they comply with our internal policies.

4. Services Provided

Saayam For All acts as a connector and facilitator. We do not directly provide emergency services, professional advice, or regulated aid. Our services are delivered through a network of compassionate volunteers and charitable entities. Users should understand that while we strive to match every request with appropriate support, we cannot guarantee successful outcomes or timely responses. We are not responsible for any delays or failures caused by the availability of volunteers, local conditions, or technological limitations.

5. Limitations of Services

We are not a replacement for emergency services (e.g., police, fire, medical) and do not provide any form of licensed medical, legal, or financial advice. While we facilitate help, we perform a basic verification process during the volunteer promotion stage to evaluate user suitability. However, this process does not constitute a formal criminal background check, and we cannot guarantee the complete accuracy or comprehensiveness of any user’s background. Users should exercise discretion and personal judgment when interacting through the platform. Use of our platform is at your own discretion and risk.

6. Acceptable Use

Users agree to use the Platform for lawful and constructive purposes only. Prohibited activities include, but are not limited to, fraudulent requests, abuse or harassment of volunteers, impersonation, exploitation of resources, and any form of hate speech. Users must not attempt to gain unauthorized access to systems or data. Saayam reserves the right to monitor interactions and content to ensure the integrity of our platform. Violations may result in suspension or permanent banning from the Platform.

7. Privacy and Data

We are committed to protecting your privacy. Our data policies are governed by global privacy standards and local compliance requirements. We collect only the data necessary to operate the Platform, including your contact details, service requests, volunteer activity, and location (when relevant). We do not sell your information. Your data may be shared with volunteers or organizations only when necessary to fulfill a request or improve our services. Please refer to our Privacy Policy for detailed information.

8. Non-Discrimination

Saayam For All serves all individuals regardless of race, color, religion, gender, sexual orientation, age, disability, nationality, or political belief. We ask our users and volunteers to uphold these same principles. Any behavior violating this standard may lead to immediate removal from the Platform.

9. Disclaimers

Saayam For All does not verify the professional qualifications or backgrounds of volunteers unless explicitly mentioned. Interactions between users and volunteers are based on mutual trust and good faith. While we strive for safety, we cannot ensure complete risk elimination. We disclaim liability for any physical, emotional, or material consequences arising from interactions initiated through our Platform. You are advised to exercise due diligence and take personal safety precautions during any in-person engagements.

10. Intellectual Property

11. Indemnification

By using the Platform, you agree to indemnify, defend, and hold harmless Saayam, its officers, directors, volunteers, and affiliates from and against any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your interactions with other users.

12. Modifications

Saayam For All may update these Terms at any time to reflect changes in our service offerings, user expectations, or legal obligations. When we make changes, we will update the "Effective Date" at the top of this page. Major updates may also be communicated via email or announcements on the Platform. Continued use of the Platform after changes are published constitutes your acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate access to the Platform for any user who breaches these Terms or engages in conduct harmful to the Saayam For All community. Termination may occur with or without notice, and access to any user data may be revoked unless required by law. Users can also voluntarily deactivate their accounts by contacting our support team.

14. Limitation of Liability

To the fullest extent permitted by law, Saayam shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the Platform. We do not assume responsibility for the acts or omissions of users, volunteers, or third-party partners.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which Saayam For All is legally registered. Users accessing the Platform from outside this jurisdiction agree to comply with all local laws. Any disputes arising from the use of our services will be resolved through arbitration or legal proceedings as appropriate, with preference for amicable resolution.

16. Waiver and Severability

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
