Software Terms of Use

Users acknowledge that the Vxnaid™ platform has not been approved by any health regulatory agency for any purpose. Its use for a vacation campaign will require prior approval by all relevant health regulatory agencies. Any use of the Vxnaid™ platform by any user shall be in strict compliance with all applicable local, state, federal, national and international laws. Any user shall satisfy itself that it complies at all times with all applicable local, state, federal, national and international privacy laws and regulations (e.g. HIPAA, the European Union Data Protection Directive), in particular as they apply to sensitive data. No personal data shall be processed until all appropriate consents and/or regulatory approvals have been secured by the user. Any user is required to implement suitable and specific security measures to protect the confidentiality of any data subjects, including against any theft or misuse of their identity or image. Any personal data collected by means of the Vxnaid™ platform shall be processed only by professionals subject to an obligation of professional secrecy. Johnson & Johnson, its affiliates and their respective directors, officers and employees (collectively “Johnson & Johnson “) shall have no responsibility, statutory or otherwise, in respect thereof. In particular, Johnson & Johnson does not control any personal data collected, processed, used and/or shared by means of the Vxnaid™ platform. No user shall use the Vxnaid™ platform in a manner or for a purpose that is intentionally dishonest, misleading, fraudulent or negligent, or which may cause harm, injury or damage to a third party. The Vxnaid™ platform is provided on an “as is” basis, without warranty of any kind, either expressed, implied or statutory including, without limitation, that the Vxnaid™ platform is free of defects, merchantable, fit for a particular purpose, non-infringing or that it complies with local or international laws including privacy laws. Johnson & Johnson cannot and does not warrant that use of the Vxnaid™ platform will be error- or virus-free and does not guarantee against unauthorized users or hackers attempting to obtain access to the Vxnaid™ platform. Johnson & Johnson is not responsible or liable for any communication, information or advice given by means of the Vxnaid™ platform. Johnson & Johnson is not responsible or liable for any claim, loss or damage resulting from its use by any user.
