Terms of Service

Effective Date: January 1, 2025

1. Acceptance of Terms

By downloading, installing, or using CaptionMate ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

2.1 License

Subject to your compliance with these Terms, Harrison Cho grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal or commercial use.

2.2 Restrictions

You may not:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Distribute, sublicense, or transfer the App to third parties
  • Use the App to infringe upon intellectual property rights of others

3. User Responsibilities

3.1 Content Ownership

You are solely responsible for:

  • The audio/video files you process with the App
  • Ensuring you have the right to transcribe the content
  • Complying with copyright and intellectual property laws
  • Any generated subtitles and their use

3.2 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with:

  • All applicable local, state, national, and international laws
  • Any regulations regarding data privacy and intellectual property
  • These Terms of Service

4. Privacy and Data

4.1 Local Processing

  • All transcription is performed locally on your device
  • No personal data is collected, stored, or transmitted by the App
  • See our Privacy Policy for detailed information

4.2 Model Downloads

  • AI models are downloaded from Hugging Face (argmaxinc/whisperkit-coreml)
  • Downloads occur only when you explicitly choose to download a model
  • No personal information is transmitted during downloads

5. Intellectual Property

5.1 App Ownership

The App and all related intellectual property rights are owned by Harrison Cho. These Terms do not grant you any rights to:

  • Trademarks, service marks, or logos
  • Patents or patent applications
  • Copyrights or copyrightable materials
  • Trade secrets or proprietary information

5.2 Third-Party Components

The App incorporates open-source components licensed under:

  • Whisper: MIT License (OpenAI)
  • WhisperKit: MIT License (Argmax, Inc.)

6. Disclaimer of Warranties

6.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of transcriptions

6.2 Transcription Accuracy

While we strive for high-quality transcriptions:

  • Accuracy depends on audio quality, accents, and background noise
  • The App may not perfectly transcribe all content
  • You should review and verify all generated transcriptions

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARRISON CHO SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions or data loss
  • Any damages arising from your use or inability to use the App

8. Updates and Modifications

8.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. You are encouraged to keep the App updated to the latest version.

8.2 Terms Updates

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

9. Termination

9.1 By You

You may stop using the App at any time by deleting it from your device.

9.2 By Us

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
