Overview
Xieon’s Gaming Corner (XGC) is a community for gamers, content creators, and tech enthusiasts. We value our users’ privacy, freedom, and right to enjoy our platforms—Discord, bots, GitHub organization, and streams—without undue interference. Recent events, like the leak of classified U.S. government information on a Discord server, and personal experiences, such as Nintendo’s copyright strike against our streams, have underscored the need for a clear stance on legality, user data, and compliance with external requests. This policy outlines XGC’s position on user data, government requests, corporate demands, and legal obligations.
XGC’s Stance on Government Requests
XGC’s default response to any government request for user data, whether from federal, state, or local authorities, is a firm “FUCK YOU NO” unless accompanied by a valid court order from a recognized U.S. court. We do not comply with informal requests, fishing expeditions, or demands lacking legal authority. Only the following U.S. courts can compel XGC to provide user data:
- U.S. Supreme Court
- Federal District Courts
- U.S. Courts of Appeals
- State Supreme Courts (50 U.S. states, Washington D.C., Puerto Rico)
- State Appellate Courts
- State Superior Courts (e.g., Essex County Superior Court)
- State or Local City/Town Courts
Non-U.S. Courts and Users
XGC will not honor requests from courts outside U.S. jurisdiction, regardless of the requesting country. For users who are not U.S. citizens, XGC will not disclose any information to any entity, U.S. or foreign, without a valid U.S. court order. For dual citizens (where one citizenship is U.S. and a treaty exists between the U.S. and the other country), XGC may honor requests from the non-U.S. country’s courts, but only if a U.S. court order validates the request and complies with the treaty.
Corporate Requests (e.g., Discord, YouTube, Nintendo)
XGC will not comply with requests from companies, including Discord, YouTube, Twitch, Facebook, Kik, or Nintendo, unless a valid U.S. court order specifies the exact information to be provided. Even then, XGC will provide only the court-ordered information and nothing more. Our experience with Nintendo’s aggressive copyright strikes against our streams reinforces our commitment to protecting our community from corporate overreach. We stand with content creators and will not bow to pressure from companies without legal compulsion.
Legal Obligations and Serious Crimes
Per Discord’s Terms of Service and U.S. law, XGC is required to report certain serious crimes (e.g., murder, terrorism) to authorities if disclosed in our platforms. For example, if a user states, “I killed someone and feel guilty,” XGC staff are obligated to report this to law enforcement once to comply with legal requirements. Failure to do so could make XGC an accessory after the fact. However, XGC will not participate further or provide additional information without a U.S. court order. Users are advised to avoid admitting to serious crimes directly. Instead, frame such discussions hypothetically (e.g., “I had a dream,” “In a GTA roleplay server”) to avoid triggering mandatory reporting.
User Data Protection
XGC collects minimal user data (e.g., Discord user IDs, timezones for bot reminders) necessary for our bots and community operations. We do not share, sell, or disclose user data except as required by a valid U.S. court order. Our bots (e.g., XGC Bot) and GitHub repositories are designed to prioritize user privacy, and we encrypt or anonymize data where feasible. Users are responsible for their conduct on our platforms, and we encourage vigilance to protect personal information.
Nintendo and Content Creation Risks
Nintendo’s history of targeting content creators, including our own copyright strike, highlights the risks we face. XGC supports fair use and creative expression but must comply with DMCA takedowns to avoid legal repercussions that could jeopardize our streams and community. We advise users to be cautious with copyrighted material and to consult legal resources if faced with corporate actions.
Subpoenas and Court Orders
If XGC receives a subpoena or court order from a recognized U.S. court, we will:
- Verify the order’s authenticity and jurisdiction.
- Provide only the specific information required by the order.
- Notify the affected user(s) unless prohibited by the court order. We will challenge overbroad or invalid orders to the fullest extent possible. XGC will not comply with subpoenas from non-U.S. courts or entities lacking U.S. jurisdiction.
