A. Donation Policy

A.1 Non-Refundable Donations

All donations made to XGC are non-refundable. Donations are considered voluntary contributions to support XGC, with no promise of goods or services in exchange unless otherwise explicitly stated. Once a donation is made, there is no obligation on XGC's part to provide any material or non-material compensation, though we may offer gifts or perks at our discretion.

A.2 Gifts and Perks

Under certain circumstances, if a donation is made without any prior promises or expectations, XGC may choose to gift the donor a perk as a gesture of appreciation. These gifts may include, but are not limited to:

  • A Tier 1 Subscription to the XGC Discord
  • VIP or Moderator status on XGC's Twitch or YouTube channels
  • Other similar perks or benefits that may be considered by XGC staff

It is important to note that these gifts are after-the-fact considerations and are not guaranteed or promised at the time of donation. If you are dissatisfied with any gifted perks or benefits, you are not entitled to a refund or any additional compensation.

A.3 Refund Policy for Donations

For donations, the funds given are non-refundable. If a user seeks to reverse or chargeback a donation, XGC will pass on all charges incurred as a result of chargebacks, cancelled donations, or refunded donations processed through third-party services such as CashApp, Venmo, or similar platforms.

A.4 Chargeback and Dispute Handling Fees

In the event of a chargeback, cancelled donation, or any refund action taken by a third-party payment processor, XGC will charge the user the following fees:

  • Chargeback/Refund Fees: Any fees or penalties imposed by the payment processors will be passed onto the user.
  • Administrative Fees: XGC will charge an hourly rate of $100 per hour, prorated by the minute, for any time spent dealing with issues related to chargebacks, disputes, or cancelled donations. This includes time spent:
    • Corresponding with third parties (e.g., payment processors).
    • Interacting with individuals or entities seeking a refund, including friends, associates, or legal counsel representing the user.
    • Resolving disputes or misunderstandings that involve individuals acting on the user’s behalf, either intentionally or unintentionally.

A.5 False Information and Defamation

XGC considers the intentional falsification of information related to donations as defamation. If a user provides false information to any third party—including but not limited to tax authorities, law enforcement, or any other individuals or entities—about a donation, it will be viewed as a serious legal matter.

  • Defamatory Statements: Providing false information about XGC or its donation policies to any external parties (including tax authorities, law enforcement, or other third parties) may expose the individual to legal liability for defamation.
  • Retaliatory Actions: If XGC determines that false or defamatory statements have been made about the organization or its policies, XGC reserves the right to:
    • Pursue legal action against the individual making the false claims.
    • Suspend or permanently ban the individual from participating in any XGC activities, platforms, or communities.
    • Seek compensation for damages caused by the defamation, including any legal costs incurred.

XGC takes these matters seriously and will take all necessary steps to protect the integrity of its services and its reputation in the community.

A.6 No Refunds for Gifted Memberships or Perks

If a user is gifted a premium membership, perk, or other benefits as a result of a donation and is dissatisfied, they are not entitled to a refund. The gifting of such benefits is an appreciation gesture, not an entitlement.

XGC reserves the right to refuse or cancel any donations, and all donations are subject to review and final decision by XGC.

B. Legal Compliance

XGC will comply with all legal obligations, and donations are subject to the legal terms set forth in this policy. Users agree to adhere to these terms and accept full responsibility for any chargeback or refund actions they initiate or that are taken on their behalf.
