SMS Forge Terms of Service and End-User License Agreement (EULA)

This document constitutes the End-User License Agreement (EULA) between Theliel (the “Developer”) and you (the “Licensee”) for the use of the SMS Forge mobile application (the “Software”).


1. Proprietary License Grant

SMS Forge is provided as a Proprietary Software developed by the Developer as a personal project. The Developer grants the Licensee a non-exclusive, non-transferable, revocable license to use the Software solely for personal and internal research purposes on any Android device owned or controlled by the Licensee.

Prohibited Uses:

The Licensee shall not, without the Developer’s prior written consent:

  • Sublicense, sell, rent, lease, or distribute the Software.
  • Reverse engineer, decompile, or disassemble the Software.
  • Use the Software for any unlawful, malicious, or fraudulent purpose.


2. In-App Purchase and Full Feature Access

The Software may be downloaded for free, but certain core functionalities or persistent use features are locked and require a one-time In-App Purchase (the “Full Feature Unlock”).

Scope of Unlock:

  • The Full Feature Unlock grants perpetual access to all currently existing and future features of the Software on the device linked to the Licensee’s Google Play account.
  • Non-Refundable: As the Software’s utility is immediately accessible upon unlocking, all In-App Purchases are non-refundable, except as required by the terms of the Google Play Store or applicable law.


3. Disclaimers and Limitations of Liability

The Software is provided “as is,” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

Hardware and System Interaction:

  • The Developer makes no warranty that the Software will function correctly on all devices, especially considering its reliance on low-level modem access. Compatibility issues are acknowledged in the ‘Modem Compatibility’ documentation.
  • User Responsibility: The Licensee acknowledges and agrees that they are solely responsible for all actions and consequences resulting from the use of the Software, particularly those involving customized PDU messages. The Developer shall not be liable for any damages, legal issues, or network interference arising from the Licensee’s use.


4. Termination

This EULA is effective until terminated. The Licensee’s rights under this EULA will terminate automatically without notice if the Licensee fails to comply with any of its terms. Upon termination, the Licensee must cease all use of the Software.


5. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of laws principles.
