Terms of Service for Aperture Viewer

IMPORTANT NOTICE – PLEASE READ CAREFULLY

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and the Aperture Viewer Development Team ("the Project," "we," "us," or "our") governing your download, installation, and use of the Aperture Viewer software (the "Software").

BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.

1. Acceptance and Relationship to Platform Terms

Your use of the Software to access the Second Life virtual world requires you to separately agree to the Linden Lab Terms of Service. You acknowledge that our Software is a third-party tool providing access to a service governed by Linden Lab. Our Terms govern your use of the Software itself; Linden Lab's Terms govern your activity on their service. You must comply with both.

2. License to Use

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to install and use the Software. The source code for the Software is made available under the GNU Lesser General Public License v2.1 (LGPL), which has its own separate terms. These Terms govern your use of the distributable, binary version of the Software.

3. Prohibited Conduct

You agree not to, and not to permit others to: a) Reverse engineer, decompile, or disassemble any proprietary, non-LGPL components of the Software. b) Use the Software for any illegal, malicious, or fraudulent purpose. c) Interfere with or disrupt the operation of the Second Life service. d) Misrepresent your identity or affiliation with the Aperture Viewer Project. e) Use the Software to violate the intellectual property rights of others. f) Circumvent any security features of the Software or the Second Life service.

4. Intellectual Property

The Software, including its object code, design, and the "Aperture Viewer" name, logos, and trademarks, are the exclusive property of the Aperture Viewer Project and its licensors, except for rights granted under the LGPL.

5. Proprietary and Confidential Code

You acknowledge that the publicly available source code repository for the Software constitutes the entirety of the code licensed to you under the LGPL. Any and all code, algorithms, assets, binaries, or other intellectual property related to the Software that are not present in the public source code repository are considered the proprietary and confidential property of the Aperture Viewer Project ("Proprietary Code").

You are expressly forbidden from accessing, using, copying, modifying, distributing, or reverse-engineering any Proprietary Code without the express prior written permission of the Aperture Viewer Project.

Any unauthorized access to or use of Proprietary Code shall be considered a material breach of these Terms and will be treated as willful copyright infringement under applicable federal and international law.

6. Distribution of Software

a) Official Public Releases: The sole, authorized source for the official public release of the Software is the "Releases" section of the official Aperture Viewer GitHub repository. While the LGPL license grants you the right to redistribute the Software, we strongly advise against obtaining it from any third-party source. We disclaim all liability, warranty, and support for any version of the Software obtained from any source other than the official repository. You use such third-party distributions entirely at your own risk.

b) Private Development Builds: From time to time, the Project may grant specific individuals limited access to non-public, pre-release, or experimental versions of the Software ("Development Builds"). Your license to use a Development Build is strictly limited, personal, non-transferable, and expressly forbids any form of redistribution to any third party, in whole or in part.

Possession of a Development Build does not grant you any right, title, or interest in the source code of its proprietary features. The unauthorized distribution of any Development Build is a material breach of these Terms. Such a breach will result in the immediate and automatic termination of all licenses granted to you by the Project. Any subsequent copying or distribution will constitute willful copyright infringement, and we reserve the right to pursue all available legal and equitable remedies.

7. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE APERTURE VIEWER DEVELOPMENT TEAM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SOFTWARE IS LIMITED TO TEN U.S. DOLLARS ($10.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless the Aperture Viewer Development Team from and against any claims, liabilities, damages, and expenses arising out of or in any way connected with your use of the Software or violation of these Terms.

10. Termination

We may, in our sole discretion, suspend or terminate your license to use the Software at any time, for any reason, including for any breach of these Terms.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any dispute not resolved through negotiation shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) in Wilmington, Delaware.

12. General Provisions

These Terms, along with our Privacy Policy, constitute the entire agreement between you and the Project regarding the Software.
